Terms of Service

1. What the service is

Amnesia AI is a desktop application that detects and masks sensitive identifiers in text on your device before it is sent to a third-party AI model of your choosing, then restores the real values in the response you see. We also operate a gateway that proxies and meters those requests, and an account dashboard for billing and settings.

2. Accounts

You need an account to use paid features. You are responsible for the accuracy of your account information and for activity under your credentials. Notify us promptly at support@amnesia.ai if you suspect unauthorized use.

3. Plans, credits, and billing

• Credits are the usage currency: 1 credit equals $1 of usage, pooled per organization.
• Paid plans (Individual, Teams, Practice) are billed on a recurring basis through Stripe until cancelled.
• You can cancel a subscription at any time, self-serve, from your account dashboard.
• Fees are non-refundable except where required by law or stated otherwise at the time of purchase.
• We may change pricing on a going-forward basis with notice.

4. Acceptable use

You agree not to:

• Use the service for anything illegal, or to violate the rights of others.
• Attempt to circumvent, reverse-engineer, or defeat the masking, metering, or licensing mechanisms of the service.
• Attempt to re-identify individuals from another customer's masked data, or otherwise probe the service to expose data it is designed to withhold.
• Resell or provide the service to third parties without our written consent.
• Overload or abuse the gateway or shared infrastructure.

5. Your content

You retain all rights to the data you process through Amnesia AI. We do not claim ownership of it, and, by design, our servers never see it in unmasked form. You are responsible for having the right to process any data (including client or patient data) you submit, and for complying with any professional, contractual, or legal obligations that apply to it.

6. Third-party AI models and outputs

Amnesia AI routes masked requests to AI models operated by independent third parties (for example Anthropic, OpenAI, or xAI). We do not control, and are not responsible for, the accuracy, availability, or output of those models. AI-generated output can be wrong. You are responsible for reviewing and verifying any output before relying on it, particularly in tax, legal, medical, or financial contexts.

7. No compliance guarantee

Amnesia AI is designed to support data-minimization workflows and to reduce what leaves your device. It does not itself create attorney-client privilege or work-product protection, does not determine whether information is discoverable, and does not by itself confer compliance with HIPAA, GDPR, GLBA, or any other law. Masking is best-effort software: review-first mode lets you see and approve the exact payload before it is sent, and we recommend using it for anything you cannot afford to get wrong.

8. Intellectual property

Amnesia AI®, our logos, and our product name are our trademarks. The service, including its architecture and any patent-pending methods, is owned by us or our licensors. Nothing in these terms transfers that ownership to you, beyond the limited right to use the service as intended.

9. Termination

You may stop using the service and delete your account at any time. We may suspend or terminate access for breach of these terms, non- payment, or misuse that puts other customers or our infrastructure at risk. Your locally stored, encrypted data remains yours and exportable regardless of account status, since it never depended on our servers to exist.

10. Disclaimers

The service is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that detection will catch every sensitive value in every input.

11. Limitation of liability

To the maximum extent permitted by law, Amnesia AI will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the service. Our total liability for any claim relating to the service is limited to the amount you paid us in the twelve months before the claim arose.

12. Indemnification

You agree to indemnify and hold us harmless from claims arising from your misuse of the service or violation of these terms, or of any law or third-party right in connection with the data you process.

13. Governing law

Amnesia AI LLC is a Delaware limited liability company. These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles, unless a mandatory local consumer-protection law says otherwise.

14. Changes to these terms

We may update these terms from time to time. We will update the date at the top of this page and, for material changes, provide reasonable notice before they take effect. Continued use after changes take effect means you accept them.
